THE legal team defending Major Charles Ingram against insurance fraud charges say they are considering making an application to have the case thrown out.

They believe that Major Ingram, who was found guilty with his wife Diana of attempting to cheat on the TV quiz Who Wants To Be A Millionaire, cannot receive a fair trial following the international publicity that accompanied the earlier case.

Major Ingram is due to appear at Salisbury Crown Court tomorrow for a pre-trial review. He faces two charges of gaining a pecuniary interest by fraudulent means, dating from 1997 and from August 2001, when he and his family moved to High Street, Easterton.

Major Ingram's solicitor, Stephen Gentle of London-based Kingsley and Napley, said that they were not contemplating asking the judge to dismiss the case, but that could change.

He said yesterday: "Things are very fluid at the moment. Friday's hearing is a very formal matter and we are hoping to set a date for a further hearing at which we might make an application to dismiss."

At the end of last year, a judge at Salisbury Crown Court banned the press from making any reference to the case until the quiz show hearing had ended.
