LABOURER Daniel Bevan has been banned from driving for three years for being three times over the legal drink driving limit.

Bevan, of Bailey Close, Devizes, had 105 microgrammes of alcohol in 100 millilitres of breath; the legal limit is 35 microgrammes.

Police found Bevan, 29, in his car in the Market Place, Devizes, at about 9.30pm on June 14.

They had been called by a member of the public who believed he was intoxicated after she saw him leave a pub in Melksham.

When police stopped him his car engine was switched off and the keys were in the ignition and he was sitting in the driver's seat.

He was unable to provide a sample for a roadside breath test so was

arrested for failing to do so and at the police station he provided a breath sample of 105 microgrammes.

He told the police he had set off from home at 2pm and had consumed a pint of lager at the Black Swan in Devizes after which he went to the Tavern in Melksham and another pub at which he said he drank non-alcoholic J20s.

Bevan, a labourer/plasterer, pleaded guilty at a previous hearing and the case was adjourned until Tuesday for pre-sentence reports.

Emm Wrench, defending, said the psychological report showed Bevan had learning difficulties for which he required assistance with day to day management skills.

The three-year ban was imposed after magistrates in Devizes were told that this was Bevan's second drink drive offence.

On Tuesday the magistrates also fined Bevan £400.
