Teenager Adam Rose, who was convicted of assaulting a man in a late night attack, has had his sentencing put off after the probation service failed to compile a report.

Adam Rose, 19, of Waylands, Devizes, has been warned he could face jail for the attack on builder Roy Wylie outside shops in Eastleigh Road in July last year.

Following a trial in March, a jury at Swindon Crown Court convicted Rose of actual bodily harm but cleared his dad Kevin of a similar charge.

A jury heard that the defendants' family had experienced problems from John Dalley, the former boyfriend of Rose's half sister Donna Edwards.

On July 19, Rose, a supermarket bakery worker, had bumped into Mr Dalley in the town centre. Later Kevin Rose, 50, said he agreed to meet Dalley near the One Stop shop.

But Mr Wylie said that he had bumped into Mr Dalley in the Corn Exchange and then saw him again later extremely drunk and nursing a cut face. He said that he took him home and told him he could sleep there, but was annoyed by his guest's mobile phone which kept ringing.

Mr Wylie, 36, said he answered it and agreed to meet the person on the other end to get them to stop calling.

But when he got to the shops he was met by a group of about seven and he was grabbed by Rose senior and then punched and kicked by the others as he was on the ground.

Rose senior admitted he grabbed Mr Wylie to restrain him because he was lashing out. His son denied any wrongdoing but a witness saw him kicking Mr Wylie in the head and stomach. Both men denied actual bodily harm and the jury found Kevin Rose not guilty but convicted his son of the offence.
