Wiltshire Police are to be investigated by the Independent Police Complaints Commission over the death of takeaway shop owner Mesut Kayran.

He died in a car accident hours after police were told there was mud on the road where he crashed.

On October 23 Mr Kayran, who ran Malmesbury Pizza and Kebabs as well as a business in Swindon, was delivering an order on the B4014 between Malmesbury and Tetbury when his Vauxhall Astra was involved in a collision with a Renault Megane.

A member of the public had rung Wiltshire Police at 5.50pm to report mud on a section of the B4014 and police attended the site.

An hour later an accident occurred on the same stretch of road, followed by the fatal crash of Mr Kayran at 8.40pm.

Nadia Farooq, the sister of Mr Kayran’s widow Noreen, said the family were pleased that the IPCC were opening an investigation. Mrs Farooq said: “It is a good thing that the responsibility of the police in this situation is going to be investigated.

“It is very upsetting because Mesut’s accident happened only two hours after another accident on the same road. There was mud on the road, which should have been removed.

“The mud probably came from a farmer or something.”

She added: “It’s not the first accident that has happened there. But the investigation isn’t going to bring Mesut back.

“All we can do is leave it in God’s hands.

Mrs Farooq said: “The police liaison officer has been very good and kept us up to date with what is going on.”

Yesterday the chairman of the Brokenborough Parish Council, Bob Tallon, said he couldn’t comment on the current investigation.

However at the time of accident he said: “I’ve been told the accident may have been because of mud on the road.

“I spoke to the company who were called in to do the cleaning and the road was spotless after it was reopened.”

Mr Tallon said the road had improved significantly since money was spent resurfacing it three years ago.

He said: “There used to be a number of accidents on the corner at Sunset Hill with cars coming off the road.”

IPCC Commissioner Rebecca Marsh said: “We have decided that this fatal incident should be investigated independently.

“IPCC investigators will be investigating the response and actions of the police following an earlier report from a member of the public of mud on a section of road and will investigate the circumstances leading to the road traffic incident that occurred at 6.50pm.

“The police force is investigating how the mud may have been deposited on the road.”
