A DEVELOPER has launched an appeal against a decision to not release a covenant on land designated for education.

Today(September 13) is Malmesbury resident's last chance to comment on the appeal by Bloor Homes South West which would see the covenant on land at Filands Road released.

The decision on the planning bid has not yet been decided but Bloor Homes has gone straight to appeal citing Wiltshire Council’s failure to make a decision.

In its case statement the agent for the developer said: “The outline planning application was submitted to Wiltshire Council and validated February 16, 2021.

“The application was not determined within the statutory 13 week determination period.”

The land in question was originally part of development plans by home builder Gleeson, but was sold to Bloor Homes in the mid-2010s.

Under Gleeson’s planning bids, the land was subject to a planning obligation which would see it used for educational purposes only.

In its design and access statement, Bloor said: “The southern land parcel is subject to a planning obligation that requires transfer to the council with a covenant that the land be used solely for educational purposes.”

Bloor applied to discharge this condition after “numerous historic attempts to transfer the land to the council for use as a primary school”.

Residents who wish to comment on the appeal must contact the planning inspectorate by the close of today (September 13).

The appeal is set to begin on November 23, 2021.
