A MAN was rugby tackled to the ground and attacked after getting a kebab in what is thought to be a case of mistaken identity, a court has heard.

Luke Robinson also bit the victim on the cheek and repeatedly punched him before having to be “forcibly restrained and removed” during a boozy night out in the town centre.

But the 20-year-old, who is currently sofa surfing at his sister’s address in Ormand Close, Cirencester, has no idea why he did it but admitted he has never drunk as excessively before as he did on the night in question. His tipple included Amaretto, rose wine and Jack Daniels.

Yesterday, he pleaded guilty to actual bodily harm on the man who was waiting for a taxi with friends outside Alexander House in Fleming Way on Saturday, October 29.

Robinson’s defence solicitor, Philip Hall, told the court: “He tells me not long before this incident he split up with his girlfriend of some three years. That left him without a roof over his head, so he was sofa surfing.

“On that night he had been out with his sister and they became separated. He can remember leaving the club and that’s about it.

“It was out of character and he doesn’t want to be a regular fixture in places like this again.”

Robinson was sentenced to a 12 month community order, which also means he will have to do 100 hours of unpaid work and attend 10 rehabilitation requirement days.

Magistrates ordered him to pay compensation of £150 to the victim, as well as £170 in court costs.
