The Clean Neighbourhoods and Environment Act 2005 The Dog Control Orders (Prescribed Offences and Penalties, etc) Regulations 2006 (S.1.2006/1059)
Devizes Town Council intends to make the above Order and invites comments on the proposal by 1 April 2013.
What does the Order require? It makes it an offence for a person in charge of a dog to be in Hillworth Park unless the dog is on a lead ofno more than 2 metres.
When will it come into force? It is proposed to come into force on 1 July 2013, subject to this consultation.
What are the penalties for non-compliance? The maximum fine is level 3 on the standard scale, currently £1000. An authorised officer can give an offender a fixed penality notice of £75 in lieu of prosecution.
Are there any exceptions? No but there is a defence of "reasonable excuse."
