Corsham man guilty of flytipping

A CORSHAM man has been fined £1,000 and ordered to pay £882.46 costs after admitting two offences of flytipping.

At Chippenham Magistrates Court, Ian Cundick, 23, of Weller Road, Corsham, pleaded guilty to two offences relating to the management of waste in proceedings brought by North Wiltshire District Council.

In December 2006, the council received a report of a flytipping incident at Shockerwick bridge, near Box.

The material comprised of builders' waste and related material.

This was investigated by council enforcement officers who were eventually able to trace a number of items found in the flytipped waste back to material that had been collected by Cundick from two properties in Bath and Bradford on Avon.

Cundick pleaded guilty to the offence of failing to take reasonable steps to prevent waste material under his control being deposited on land for which there was no waste management licence in force.

He told the court that he had been unable to dispose of the waste at a licensed site at the time and accepted that he had not taken sufficient steps to keep it secure and to prevent it being taken by others.

Cundick was fined £750 for this offence.

He also pleaded guilty to an offence of failing to supply copies of waste transfer notes to the council when requested.

As a person who keeps or carries waste, Cundick was required to keep records of all transfers of waste. For this offence, he was fined £250.

North Wiltshire District Council says it takes seriously any failure by those who produce, carry or transfer waste to comply with their obligations to exercise proper care and control of such waste and to keep the necessary records.
