A CHIPPENHAM man has been given an £80 fine after being prosecuted for fly-tipping which included a toilet and bathtub, after paying someone else to remove the waste.

Brian Chamberlain, of Hungerdown Lane, pleaded guilty to fly-tipping at Swindon Magistrates’ Court on October 3 after a large quantity of waste was found dumped on a by-way on Easton Lane in Chippenham.

The waste, which was found on June 10, included a bicycle, bathtub, toilet, grass trimmings as well as a computer which contained personal information belonging to Chamberlain.

He was formally interviewed under caution by a Wiltshire Council enforcement officer where he admitted the waste belonged to him.

He also stated he had been approached by two men four or five weeks earlier who offered to take his waste away for £30, but that he had not checked if they were licensed waste carriers.

Councillor Philip Whitehead, cabinet member for highways, said: “This recent prosecution highlights that fact that members of the public or businesses should not pass their waste to anyone who is not licensed.

“We urge all residents and businesses to carry out checks on these people including; making records of their vehicle details and where the waste is being deposited.

“If such checks are not made, the resident or business can be prosecuted for not complying with their duty of care regarding lawful waste management.”

As well as an £80 fine, Chamberlain also paid a victim surcharge of £20 and £200 in legal fees.
