Developer criticised over change to windows

A Malmesbury property developer, who was fined nearly £8,000 for ignoring planners earlier this year, has flouted planning laws again.

A judge at Swindon Crown Court sentenced Frank Faryab, 56, from Oxford Street in Malmesbury in April, for breaching an enforcement notice issued in February 2003 by district council planners.

The offence related to work carried out on The Manse, a corner property in Malmesbury, next to the Moravian Church.

Mr Faryab has now submitted a retrospective planning application for windows which he has already added, with changes to the design of the window casing.

Town councillor Charles Vernon said it was strange Mr Faryab had submitted a retrospective application when he previously got into trouble with the district council for essentially doing the same thing.

Coun Vernon said: "It is a bit strange. I think Mr Faryab is applying retrospectively for what he has done will result in a difficult decision. I do not think these dormer windows are in character with the building."

During Mr Faryab's court hearing in April, Simon Goodman, prosecuting, said Faryab had submitted a number of applications for renovations to the Grade II-listed building.

Faryab originally denied the matter but changed his plea to guilty.

He was told to remove three windows in the front, south elevation and alter others.

Comments on the application must be sent to the district council by November 3.
